Terms of Service for Mpixe

Please read these terms carefully. By using the service or creating an account, you agree to be bound by them. If you do not agree, do not use Mpixe.

In short: This is an agreement between you and Mpixe. By using the service, you agree to it.



1) Overview of the Service

Mpixe aims to help people discover, save, organize, and share visual ideas. To improve the experience, we show content that may be relevant to you based on your activity on and off Mpixe, in accordance with the Privacy Policy.

What you see may include promotional content from advertisers or merchants, which we clearly label.

In short: We show you content, suggestions, and ads relevant to what you like.



2) Using Mpixe(A) Eligibility & Account Creation

  • You must be at least 13 years old. If you are 13–18, parental/guardian permission is required.
  • Using Mpixe may require automatic software updates.
  • When creating your account, you provide accurate and complete information and keep your password confidential.

(B) Usage Limits

You agree not to:

  • Copy or harvest Mpixe data or content by automated means without express permission.
  • Attempt unauthorized access to the service or data.
  • Violate applicable export controls or trade sanctions.
  • Reverse engineer the service or create derivative works except as permitted by law or our licenses.

(C) License to You

We grant you a limited, non-exclusive, revocable license to access and use the service under these terms and our policies.


(D) Commercial Use

  • If you use Mpixe for commercial purposes (including advertising, selling, or running a shop), you must create a Business Account and agree to Mpixe Business Terms.
  • If you open an account for an entity, you represent you have binding legal authority for that entity.

In short: Follow the law, don’t use automated tools without permission, and open a Business Account for commercial activity.



3) User Content(A) Your Responsibility

“User Content” includes images, videos, comments, links, and any materials you upload or post. You remain the owner of your rights in the content and are solely responsible for it and for complying with the law and our policies (including Community Guidelines).

Posting content that infringes others’ rights (copyright/trademark/privacy, etc.) or is illegal is prohibited. We may remove or restrict violating content or take action on violating accounts under our Enforcement Policies.


(B) License You Grant to Us and Others

By uploading or posting content, you grant Mpixe and its users a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, store, publicly display, reproduce, save, modify, create derivative works from, translate, distribute, and promote the content on and off the service, to the extent needed to operate, improve, and promote the service. This does not entitle you to any payments unless we explicitly say otherwise.


(C) How Recommendations Work

Recommendations are based on factors such as your interactions, topics we think fit your interests, and patterns from users with similar interest profiles. You can adjust some personalization settings in Privacy & Data.


(D) Retention of Content

When content is deleted or an account is closed, we may retain backups for a reasonable period. Copies saved or re-shared by other users may remain available to them under the license granted.


(E) Feedback & Suggestions

If you share ideas or feedback, you agree we may use them without an obligation of confidentiality or payment, and you will not provide third-party confidential information.


(F) Reporting Channels

We provide mechanisms to report content you believe violates the law or our policies. Reports must be in good faith and without abuse.

In short: You own your content but give us a broad license to run the service. We may keep backups; your content must follow the law.



4) Intellectual Property

  • We respect IP rights and will respond to notices per law and our Copyright & Trademark Policy.
  • All rights, title, and interest in Mpixe—its technology, marks, and interfaces—belong to us and our licensors. Users acquire no ownership in the service.

In short: Don’t use our marks, code, or designs except as permitted.



5) Security

We work to protect accounts and content, but breaches can still happen. Keep your password safe and notify us promptly of any unauthorized use.

In short: Security is a shared responsibility.



6) Third-Party Links & Services

The service may contain links or components from third parties. We are not responsible for their sites, products, or policies. Your use is at your own risk.

In short: External links are outside our control.



7) Termination & Suspension

We may suspend or terminate access if you violate these terms or the law. We will try to provide notice when appropriate and may offer an appeal process. You can delete your account at any time in Settings.

In short: We can stop access for violations; you can leave Mpixe anytime.



8) Indemnification

If you use the service for commercial purposes without complying with the Business Terms or cause claims due to your use, you agree to indemnify Mpixe and its affiliates and employees for reasonable claims and losses (including attorneys’ fees) as permitted by law.

In short: If you break the commercial rules and cause legal trouble, you cover the cost.



9) Disclaimer

Mpixe and its content are provided “as is” and “as available” without any express or implied warranties—including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the service will be error-free, uninterrupted, or free of harmful components, nor the accuracy or completeness of all content.

In short: No warranties—use the service as is.



10) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, special, consequential, or punitive damages, or for loss of profits/data/goodwill. Our total liability for all claims relating to the service is capped at US $100 (or equivalent). This does not affect liabilities that cannot be excluded by law (e.g., death or personal injury from gross negligence).

In short: Our liability is very limited as allowed by law.



11) Dispute Resolution

Before any legal action, both parties must try informal resolution by emailing our legal team at [email protected] (include a description of the dispute and contact details). If unresolved within 60 days of acknowledgment, disputes may go to binding arbitration or—if eligible—to small-claims court, as set out below.

  • EEA/UK/Switzerland consumers: Mandatory arbitration does not apply; you may go to your local courts under applicable law.
  • All other regions: Arbitration is governed by the U.S. Federal Arbitration Act (or a comparable national law if outside the U.S.). Arbitration is individual, not class-wide. We will publish supplemental arbitration rules on our site.

In short: We try amicable resolution first; otherwise, individual arbitration unless your local law says otherwise.



12) Advertising & Public Content — Responsibility and Protection

  • Publishing Responsibility: You are solely and fully responsible for any content you post on Mpixe, including commercial ads and personal or public content. You confirm you have all necessary rights and licenses and that your content complies with applicable laws and Mpixe policies.
  • No Mpixe Responsibility: Mpixe is not the publisher of user content and does not endorse it. We bear no responsibility for its accuracy, legality, or consequences, including any damages or claims arising from user-posted ads or public content.
  • Protection of Marks & Personalities: Mpixe provides effective reporting and enforcement tools to protect against trademark misuse, identity impersonation, unlawful defamation, misleading ads, and any use that harms the reputation of brands or persons contrary to law or our policies. We may, at our reasonable discretion, remove violating content, restrict access to it, or take account-level actions.
  • Limits of Protection & Free Expression: This protection does not restrict lawful opinions or non-defamatory criticism or other content protected by freedom of expression under the law. Mpixe is not a court; we may ask for documentation or evidence before acting and do not guarantee removal unless the content violates the law or our policies.
  • Advertiser Obligations: If your content is promotional/advertising in nature, you must clearly disclose it, comply with advertising and consumer-protection laws, and not imply sponsorship, partnership, or licensing unless true and authorized.
  • Indemnification & Content Responsibility: You alone bear full legal responsibility for any claims or disputes arising from your advertising or public content. You agree to defend, indemnify, and hold harmless Mpixe, its affiliates, and employees from any damages or costs (including attorneys’ fees). You will handle all litigation at your own expense, and Mpixe may refer/assign to you any claim related to your content. You may not enter any settlement affecting Mpixe’s rights without prior written consent.
  • Reporting & Enforcement Channels: Mpixe provides channels to report violations (e.g., trademark abuse or unlawful defamation). Our actions may include—at our discretion—content removal, distribution limits, disabling ad features, account suspension or termination, or referral to authorities when appropriate.

Quick summary: You are responsible for everything you publish (especially ads). Mpixe is not liable for it. We provide strong tools against impersonation, unlawful defamation, and trademark abuse—without limiting lawful opinion.



13) General Terms(A) Changes to the Terms

We may update these terms from time to time. We will post the latest version on our site and notify you of material changes before they take effect. Continuing to use Mpixe constitutes acceptance of the new version.


(B) Assignment & Transfer

You may not assign these terms or transfer your rights without our written consent. We may assign them to an affiliate or lawful successor with notice when appropriate. You can terminate by closing your account if you do not agree to an assignment.


(C) Entire Agreement & Severability

These terms are the entire agreement between you and us regarding the service. If any provision is invalid, it will be modified to the minimum extent or removed, and the remainder will continue in force.


(D) No Waiver

Our failure or delay to exercise any right does not waive it.
